HP India and Resellers Fined for Anti-Competitive Practices
In a significant move by the Competition Commission of India (CCI), HP India and its network of resellers have been fined for engaging in anti-competitive practices. The agency imposed a penalty of 35.2 million rupees (approximately $365,335) on 21 HP resellers, marking a decisive action against cartelization in the industry.
Collusive Arrangements and Bid Rigging
In a separate order, the CCI revealed that WhatsApp communications demonstrated HP and 16 of its Tier 2 reseller partners were involved in a “collusive arrangement.” These communications provided evidence of bid rigging, including practices such as hedging bids, price fixing, and customer allocation, spanning from 2017 to 2020. The CCI identified HP India as playing a pivotal role in orchestrating these activities.
HP India defended its actions by stating that high prices for printing supplies forced some resellers to consider turning to low-cost counterfeit products to remain competitive. The company argued that it was “commercially forced into a position” to support the collusive agreements initiated by the Tier 2 resellers.
HP India’s Response and Market Challenges
Despite the allegations, HP India has expressed its disagreement with being labeled as the “kingpin” of the collusive arrangement. This controversy sheds light on broader issues faced by printer users, particularly the high cost of printer ink and toner. The situation is further complicated by HP’s practice of blocking third-party ink through firmware updates, which has frustrated both consumers and resellers.
As resellers threaten to shift their ink businesses elsewhere, HP faces mounting pressure to encourage users to stick with HP-branded ink and toner exclusively.
Regulatory Actions and Future Compliance
The CCI has ordered HP India and its channel partners to “cease all anti-competitive conduct” and implement training programs on competition compliance within 60 days. This directive aims to prevent future violations and promote fair competition in the market.
